SECTION 1 - APPLICATION OF THESE TERMS

These terms of service shall apply in respect of all goods and services we supply to you (“the Service”). You agree by entering into this agreement, you will not rely on any representation or understanding, whether oral or in writing, which is not included or referred to in these terms and conditions.

This website “ShootMyAd.com” (the “Website”) is operated by Film Priority Inc.

The terms “us”, “our”, “we”, and “ShootMyAd” refers to Film Priority Inc. a business prepared under Ontario law in Canada. The term “yourself”, “you”, “your” and “purchaser” refers to the individual and all legal entities associated with that individual, who purchases the services and products offered by the Website. This Website, and all services and products you may purchase from us are conditioned on your acceptance of the terms of service set forth below, without modification (the “Agreement”).

By making payment you accept & agree to these terms of service, you will have created a contract, which is legally binding and enforceable between you and us in a court of law.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools, which are added to, the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

SECTION 2 – ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

property of Film Priority Inc. and/or its content creators and protected by international copyright laws.

The entire compilation of the content found on this website is the exclusive property of Film Priority Inc. with copyright authorship.

SECTION 3 - MODIFICATION TO THE SERVICE AND PRICES

Prices for our products and services are subject to change without notice.

We reserve the right at any time to discontinue or modify the services (or any part thereof) without notice.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuation of said Services.

SECTION 4 – PRODUCT OR SERVICES & LIABILITY

ShootMyAd is not responsible for any product copyright issues that may result. ShootMyAd reserves the right to refuse any content deemed inappropriate or unacceptable.

ShootMyAd cannot predict or guarantee the approval of Video content on Facebook or Amazon. ShootMyAd can only suggest and make revisions according to Facebook's & Amazon's compliance policy.

If the video does not get approved ShootMyAd will allow up to 3 minor revisions to get the video approved. If deemed unsuccessful, client may request a refund of 50%.

Pets may be unpredictable and uncooperative. If a pet is uncooperative, additional production time maybe needed. The client may also be subject to additional fees and/or video delivery will be delayed.

ShootMyAd cinematographers will perform their tasks to the best of their ability, but ShootMyAd accepts no responsibility for unforeseen circumstances including but not limited to equipment failure, power outages, inability to attend and perform services due to illness, and/or any other situation beyond our control. In the event that unforeseen circumstances occur, ShootMyAd Cinematographers will use best efforts to provide similar services. Our sole liability in any case shall be limited to a monetary amount no greater than the total of monies paid by the Client.

SECTION 5 - REFUND POLICY & SATISFACTION GUARANTEE:

Refunds will be issued at a 50% payback of the original purchase price of appropriate content within 7 days after the refund has been approved.

Rush Delivery fee is non-refundable.

In the event of a cancelation or refund, RAW footage cannot be purchased.

In a period of 30 days from the date of completion and delivery of the video product, the original edited footage will be deleted. Replacement of the video product due to loss by you will be considered as a new purchase and full price must be paid.

SECTION 6 – AD DELIVERY

A draft copy of your ad will be ready within 10 business days (minimum) from the day we receive your product in our studio, provided you have supplied us with your completed Product Questionnaire, and all necessary materials before shipping. Purchaser understands that any delay on your part to deliver needed materials for the Video, may affect the final delivery date.

Following your online purchase, you have 60 days to ship us your product and fill out a questionnaire. It is not our responsibility to remind you to complete questionnaire or ship product. Questionnaire must be FULLY completed; if exited half way through, your video will not be fulfilled. It is your responsibility to e-mail hello@shootmyad.com to inquire about project details. It is imperative, that the purchaser must ship products with their name on it that matches the questionnaire filled.

After 60 days and if you have not shipped your product, the amount paid for the package will be credited to your account.

Any specific requests may delay delivery of Video. These include but are not limited to specific actor demographics, delays in script approval before production, specific scene requests, off-location sets requests, etc.

SECTION 7 – REVISIONS

It is the responsibility of the purchaser to provide ShootMyAd with all content for the script. 3 minor revisions are included in your purchase - any additional revisions will be an additional cost.

When providing feedback, please include as much information as possible. Screenshots and other forms of visual representation of your changes are welcomed. Also, we encourage complicated changes to be discussed with your Product Video Expert at ShootMyAd. Please note every additional requested revision will extend the deadline of your project.

Three minor revisions include, but are not limited to:

* Re-arrangement of Footage and Basic Framing

* Minor Caption Changes (Grammar, Font Choice, Style/Color, Sizing, Positioning, Removing, Adding, Stylization)

* Remove or Replace Basic Effects or Transitions

* Sound Effects & Music Changes

* Color Correction

Examples of Additional Revisions & Costs:

Scene addition – in Studio - $100

On Location - $250

Complete Re-Shoot - $350

Testimonial Re-Shoots - $50

Dialogue Changes (see complete Re-Shoot) - N/A

Translations - $75

Remove Captions - $20

Raw Footage (Clean) - $200

SECTION 8 – AGREEMENT AND AUTHORITY OF THE ONTARIO COURT OF JUSTICE

This Agreement shall be binding on and shall inure to the benefit of you and us. You agree that Ontario law will apply to all disputes arising in connection with this Agreement, this Website, and/or any product or service we provide to you. You hereby consent to the exclusive authority of the Ontario Court of Justice, for the judgment of all disputes arising in connection with this Agreement, this Website, and/or any product or service we provide to you.

SECTION 9 – OWNERSHIP PROVISIONS

We have the right to use edited or unedited video files produced pursuant to these Terms and Conditions for promotional or commercial purposes unless an alternative arrangement is made between ShootMyAd and the Customer. ShootMyAd also, reserves the right to retain ownership of any inconsistently recorded material. The copyright will belong to ShootMyAd.

The copyright of such segments will belong exclusively to ShootMyAd.

SECTION 10 – MATERIAL DISPOSAL

ShootMyAd reserves the right to dispose of all video files, audio files, edited video files, recorded materials, finished works and raw footage, after 60 days, unless arrangements are made and agreed to in writing by ShootMyAd.

Product Inventory will be returned to the customer, if a return-mailing label is provided. If not, after 60 days the product will be donated or disposed.

SECTION 11 – CLIENT GUARANTEE

Client certifies that he/she has the full legal rights to any and all photography, film, or video images supplied to ShootMyAd for use in the final product. Client agrees to guarantees, defend and hold ShootMyAd and its officers, directors, agents, employees, representatives, associates and affiliates and each of them, harmless from and against any and all losses, costs damage, liability and expense, including reasonable a lawyer fees, arising out of any claim whatsoever, directly or indirectly, from the use of copyright images supplied to ShootMyAd by Client.

SECTION 12 - COPYRIGHT

Client will have copyright ownership of the finished Video.

ShootMyAd may use any parts of it for valid business and promotional/ marketing purposes. (i.e. demo tape, Studio website demo, pictures for web or additional marketing etc.)

Full rights to the raw footage can be purchased for an additional fee of $195. Raw files and footage must be purchased within 60 days of video delivery or ShootMyAd will take full rights to the raw files.

SECTION 13 - CREATIVE CONTROL

Client input will be considered and implemented, but ShootMyAd retains creative control over the Final Video/ Product. 

SECTION 14 - PAYMENT

Full payment is due at the time of purchase. Based on your chosen package and creative requirements, the payment to ShootMyAd will be based on the prices on our website or through custom quotes.

This agreement cannot be modified without the written consent of ShootMyAd.
